1. Terms and Conditions

Welcome to Chess.Kitchen. These terms and conditions outline the rules and regulations for the use of Chess.Kitchen’s analysis service. 

By submitting a Game Analysis form to Chess Kitchen, you acknowledge that you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our analysis service.

2. Scope of Service:

Chess.Kitchen provides an analysis service where users can submit their chess games for analysis by professional chess analysts (“Chess Chefs”). The analysis provided is intended for educational purposes to help users improve their chess skills.

3. Submission of Games:

Users may submit their games for analysis through the Game Analysis form available on the website. Users are not required to create an account or register on the platform to submit their games.

4. Pricing and Payments:

4.1. The cost for analysis of one game is $29. Exclusive analysis by a Grandmaster is available at a rate of $34 per game. Payment for the service is facilitated through third-party vendors such as PayPal. All applicable taxes are included in the price of the services.

4.2. Chess.Kitchen reserves the right to change prices, at its sole discretion. The price change will not affect pricing for already provided services and does not have retroactive effect.

4.3. Chess.Kitchen is not responsible for any payment-related actions or issues that occur on the payment vendors’ platforms.

5. Refund and Cancellation Policy:

Users can cancel their request for analysis before Chess.Kitchen informs you that the analysis process began. If errors are found in the analysis and the user is unsatisfied with the service, a refund may be processed upon request. Chess.Kitchen reserves the right to return payments without providing service, at its sole discretion.

6. Limitation of Liability:

6.1 To the fullest extent permitted by applicable law, Chess.Kitchen, its affiliates, officers, directors, employees, or analysts shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to or use of, or inability to access or use, the service; (b) any conduct or content of any third party on the service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (c) any content obtained from the service; and (d) unauthorized access, use, or alteration of your transmissions or content.

6.2 Chess.Kitchen is not responsible for any harm, loss, or issues related to the use of connected tools, platforms, or third-party services, such as email platforms, chess platforms like chess.com or lichess.org, and payment platforms like PayPal or Venmo.

7. Intellectual Property:

7.1. All content and materials available on Chess.Kitchen, including but not limited to text, graphics, website name, code, images, methodologies, forms, surveys, and logos are the intellectual property of Chess.Kitchen or are used on the website with authorization, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited unless specifically authorized by Chess.Kitchen.

7.2. The analysis, recommendations, methodologies, and any other content created or provided by Chess.Kitchen as part of the service are the exclusive property of Chess.Kitchen. Users retain all rights to the original game submissions, but by submitting a game for analysis, they grant Chess.Kitchen a non-exclusive, royalty-free license to use, reproduce, and create derivative works from the submitted game for the sole purpose of providing the analysis service.

7.3. Any feedback, comments, or suggestions you may provide regarding Chess.Kitchen or the services is entirely voluntary, and Chess.Kitchen will be free to use such feedback, comments, or suggestions as it sees fit and without any obligation to you.

7.4. Any unauthorized use, reproduction, redistribution, or exploitation of the content or any portion thereof, without express written permission from Chess.Kitchen is strictly prohibited and may result in civil and criminal penalties. Chess.Kitchen reserves the right to take legal action against individuals or entities found to be in violation of this clause, and to seek necessary remedies under applicable laws to protect its intellectual property rights.

8. Indemnification:

You agree to defend, indemnify, and hold harmless Chess.Kitchen, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of or accruing from (a) your use of the service, including your submission of content that violates third-party rights or applicable laws, (b) your breach of these terms and conditions, or (c) any misuse of the service or any information, tools, or services therein provided by you or any third party accessing the service through you.

9. Privacy:

9.1. Chess.Kitchen values the privacy of its users and will exert reasonable efforts to maintain the confidentiality of the submitted data and personal information. However, due to potential vulnerabilities associated with data transmission over the internet, and the fact that we have no control over the actions of third parties, we cannot guarantee the absolute security of your personal information. By using our service, you acknowledge, accept this risk, and agree not to hold Chess.Kitchen liable for any privacy issues or consequences related thereto.

9.2. The information collected during the submission of a game for analysis is solely utilized for the purpose of providing analysis services and enhancing the quality of our offerings. Your personal information and game data may be shared with members of our network and other team members who directly or indirectly participate in rendering services or related activities. Apart from this necessary sharing, your personal information will not be disseminated to third parties without your explicit permission, unless mandated by law. For example, we commit not to selling your data or sharing it with other providers or companies for advertising purposes.

10. Miscellaneous:

10.1. These terms and conditions constitute the entire agreement between you and Chess.Kitchen regarding the use of the service.

10.2. If any provision of these terms and conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

10.3. Chess.Kitchen reserves the right to amend these terms and conditions at any time without notice. Any changes will be posted on this page.

10.4. By submitting a Game Analysis form to Chess Kitchen, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
